1.These terms and conditions outline the agreement between Travienna Family Trust (Mia Ateliers) and the client (referred to as "you" or "your"). By engaging our services for custom-made wedding gowns, you agree to these terms and conditions.

2. Contract Formation

A legally binding contract will be established in one of two ways:

a. By accepting the Estimate provided by signing it, indicating your acceptance of the terms.

b. By mutual oral agreement, resulting in a contract on the date of our verbal agreement.

We recommend thoroughly reading these terms and conditions before accepting the Estimate. Retaining a copy for your records is advisable.

3. Services

Upon contract formation, we will promptly initiate the agreed-upon Services, either immediately or as per a predetermined schedule. Our commitment to you includes:

• Providing Services with reasonable care and skill.

• Adhering to industry standards for custom-made dress services.

• Complying with Victoria's laws and regulations relevant to the Services.

4. Changes

a. General Changes: Any changes outside the original scope of Services will incur additional charges based on time and materials at a rate of $70.00 per hour.

b. Substantive Changes: Changes that affect at least 15% of the project's time or value will prompt a new estimate for your approval before work continues.

5. Client Responsibilities

You are responsible for timely decisions, providing suitable Client Content, attending fittings, maintaining body measurements, and coordinating with us effectively.

6. Examination and Acceptance

We will review and correct final products as necessary before presenting them to you. You have 3 business days to notify us of any discrepancies. Failure to do so implies acceptance of the final product.

7. Materials

Material costs are typically covered in the Estimate provided to you. However, in the event that you request specific materials such as unique embellishments or special lace types beyond what is originally included, we reserve the right to charge additional fees for postage and the extended time required to source and incorporate these materials into the gown. We will communicate these additional costs to you and seek your approval before proceeding with any material customisation.

8. Timing

We strive to adhere to agreed-upon dates, but certain factors may impact timing. If delays occur, you may choose to wait or terminate the contract with specific conditions.

9. Cancellation

Cancellation is generally not possible once an order is placed, except as required by Australian Consumer Law.

10. Priority Made-to-Order Gowns

For weddings less than 5 months away, Priority Made-to-Order gowns require a non-refundable fee of $400. Measurements must be provided at the time of placing the order for on-time delivery. No cancellations are permitted once measurements are locked in.

11. Payment

Payments are made upfront or in staged amounts as outlined in the Estimate. We charge for Services based on time or estimate, as specified.

12. GST and Late Payments

All amounts exclude GST. Late payments may incur interest. Failure to pay may lead to suspension of Services.

13. Termination

Termination is subject to specific conditions and may result in payment obligations for Services performed and Materials acquired up to the termination date.

14. Liability and Communication

We're not liable for minor defects or errors. Our liability is limited as outlined. Communication is best conducted via writing or email.

15. Amendments and Notices

We reserve the right to amend terms, provide notices, or correct errors as required, with prior notice to you.

17. Accreditation and Promotions

Mia Ateliers reserves the right to showcase Deliverables for recognition or promotional purposes, with appropriate credit.

18. Law and Jurisdiction

This Agreement falls under the laws of Victoria, Australia. Both parties submit to the jurisdiction of Victoria's courts.
